These Terms of Service ("Terms") govern your access to and use of the website, products, and services offered by Dayone Inc. ("Dayone," "we," "us," or "our") at dayonehiring.com, including the Fairness Transcript Generator and the Bias Assessment Dashboard (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What the Service Is
The Fairness Transcript is a self-assessment documentation tool. It allows organizations to record and evaluate the criteria used in their hiring decisions against a structured bias assessment framework. The Service generates a documented record (the "Fairness Transcript") based entirely on information you provide.
2. What the Service Is Not
The Service does not provide legal advice, legal opinions, legal certification, or compliance determinations of any kind. Dayone Inc. is not a law firm and does not employ attorneys to deliver legal services through this platform.
The Fairness Transcript does not guarantee compliance with any federal, state, local, or international law, regulation, or standard — including but not limited to Title VII of the Civil Rights Act, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), NYC Local Law 144, the Illinois Human Rights Act, the California Fair Employment and Housing Act, the EU AI Act, or any other employment regulation.
The Fairness Transcript does not guarantee protection from lawsuits, regulatory actions, EEOC complaints, or any other legal proceedings. No documentation tool can provide such a guarantee.
Using the Service does not create an attorney-client relationship, a professional advisory relationship, or any fiduciary obligation between you and Dayone Inc.
You should consult a qualified employment attorney for legal guidance specific to your jurisdiction, industry, and circumstances.
3. EligibilityYou must be at least 18 years old and have the legal authority to bind the organization on whose behalf you are using the Service. By using the Service, you represent that you meet these requirements.
4. Account Registration
To access paid features, you must create an account and purchase a plan. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the security of your account credentials. Dayone is not liable for any unauthorized access to your account resulting from your failure to protect your login information.
5. Plans and Pricing
Dayone offers the following plans:

Single Transcript: $500 one-time payment. Grants 30-day access to the Fairness Transcript Generator from the date of purchase.

Starter: $750 per month. 5 transcripts per month. Recurring monthly billing.

Professional: $2,000 per month. 20 transcripts per month. Recurring monthly billing.

Business: $4,500 per month. 100 transcripts per month. Recurring monthly billing.

All prices are in United States Dollars (USD). Prices may change with 30 days' written notice to active subscribers.
6. Payment and Billing
Payment is processed through our third-party payment processor (currently Wix Payments / Stripe). By purchasing a plan, you authorize us to charge your selected payment method for the applicable fees.
Recurring subscriptions will automatically renew at the end of each billing period unless cancelled before the renewal date.
If a payment fails, we may retry the charge and send you a notification. If payment is not received within 7 days of a failed charge, your access to paid features may be suspended until the balance is resolved.
7. Cancellation and Refunds
You may cancel your subscription at any time through your account settings.
Upon cancellation, your access to paid features continues until the end of your current billing period. After that, access is revoked.
No prorated refunds are provided for partial billing periods.
For Single Transcript purchases, access expires 30 days after the purchase date. No refund is provided after purchase, as the Service is immediately available upon payment.
If you believe you were charged in error, contact us at dato@dayonehiring.com within 14 days of the charge.
8. Your Responsibilities
When using the Service, you agree to:

Provide truthful, accurate, and complete information in all Fairness Transcript assessments

Use the Service only for lawful purposes related to documenting your organization's hiring decisions

Not misrepresent Fairness Transcripts as legal certifications, government endorsements, or compliance guarantees to candidates, regulators, or any third party

Not reverse-engineer, decompile, or attempt to extract the source code of the Service

Not use the Service to generate fraudulent, misleading, or deceptive documentation

Not share your account credentials with unauthorized individuals

Not use automated systems (bots, scrapers) to access the Service
9. Accuracy of Information
The Fairness Transcript is generated based entirely on information you provide. Dayone does not independently verify, audit, or validate any responses entered into the system.
The accuracy, completeness, and truthfulness of each Fairness Transcript depends entirely on the information provided by the user. Dayone is not responsible for any inaccuracies, omissions, or misrepresentations in Fairness Transcripts resulting from incorrect or incomplete user input.
10. Intellectual Property
The Service, including all software, scoring algorithms, bias assessment framework, content, design, and documentation, is the intellectual property of Dayone Inc. The bias assessment framework is protected under provisional patent #63/941,557 filed with the United States Patent and Trademark Office.
You retain ownership of the data you input and the Fairness Transcripts you generate. You grant Dayone a limited, non-exclusive license to process your input data solely for the purpose of generating your Fairness Transcripts and operating the Service.
You may not copy, modify, distribute, sell, or create derivative works based on the Service, the scoring framework, or the bias assessment methodology without written permission from Dayone Inc.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAYONE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

LOSSES ARISING FROM RELIANCE ON FAIRNESS TRANSCRIPTS IN LEGAL PROCEEDINGS, REGULATORY AUDITS, OR EMPLOYMENT DISPUTES

LOSSES ARISING FROM THE FAILURE OF A FAIRNESS TRANSCRIPT TO PREVENT OR MITIGATE A DISCRIMINATION CLAIM, LAWSUIT, OR REGULATORY ACTION

LOSSES ARISING FROM INACCURATE USER INPUT

LOSSES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT

BUSINESS INTERRUPTION, LOST PROFITS, OR LOSS OF DATA
IN NO EVENT SHALL DAYONE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO DAYONE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND REGARDLESS OF WHETHER DAYONE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
DAYONE DOES NOT WARRANT THAT:

THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS

THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE

THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE

ANY FAIRNESS TRANSCRIPT WILL SATISFY THE REQUIREMENTS OF ANY LAW, REGULATION, OR LEGAL STANDARD

THE SERVICE WILL PROVIDE LEGAL PROTECTION OR IMMUNITY FROM CLAIMS
13. Indemnification
You agree to indemnify, defend, and hold harmless Dayone Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:

Your use of the Service

Your violation of these Terms

Your misrepresentation of a Fairness Transcript as a legal certification or compliance guarantee

Any inaccurate information you provided through the Service

Any third-party claims arising from your use of Fairness Transcripts
14. Dispute Resolution
Any dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Philadelphia, Pennsylvania.
You agree that any dispute resolution will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Philadelphia, Pennsylvania.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on the website at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes.
17. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent activity, or abuse of the platform. If we terminate your account for cause, no refund will be issued.
You may terminate your account at any time by cancelling your subscription and contacting us at dato@dayonehiring.com.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dayone Inc. regarding the Service and supersede all prior agreements, communications, and proposals.
